  • (a) The measures taken to improve the accessibility of elections, including through the provision of electoral information in alternative formats such as Braille, sign language and Easy Read, an early voting mechanism, voting by mail or mobile voting services, and the accessibility of polling stations;

  • The percentage of persons with disabilities among elected representatives;

  • The measures taken to promote the participation of persons with disabilities, particularly women, in political and public decision-making positions at all levels, and to increase their awareness of their right to participate in political and public life and, in particular, their right to vote.

  • Law Number 7 of 2017 serves as the legal basis for the simultaneous holding of the 2019 General Elections for the DPR, DPD, DPRD, and Presidential Election. Although the rights of persons with disabilities are guaranteed in the Law, in its implementation there are still many obstacles and challenges faced by persons with disabilities. One of the most significant is the lack of valid and comprehensive data on the number of persons with disabilities who are eligible to vote, leading to many disability votes being overlooked.

  • In practice, we assess that the General Elections Commission (KPU) has not made maximum effort to provide equal access to persons with disabilities, especially evident in the minimal campaign material or the absence of an obligation for participating political parties to provide campaign material that is appropriate for various types of disabilities. KPU at various levels has indeed conducted socialization to persons with disabilities regarding the voting technique. However, KPU does not have a solution on how persons with disabilities can have equal access to get to the Polling Stations (TPS). Many persons with disabilities cannot come to the TPS because their own families do not have facilities such as transportation and assistive devices.

  • Notes on Access Equality in the 2019 Elections in Yogyakarta are:

    • Data. KPU does not yet have comprehensive data on the Final Voters List (DPT) of persons with disabilities. Regarding the Final Voters List for the 2nd Improvement (DPTHP-2) set by KPU for the 2019 elections, the total number was 192,828,520 voters. This DPT consists of 514 regencies/cities, 7,201 sub-districts, and 83,405 villages/wards in Indonesia. Compared to the total voting-age disabled population, the recorded data is only a few percent of the total DPT.

    • Some findings in the field confirmed: Based on the search by Difabike, in several villages, around 23 voters were found to need mobility assistance and were eventually helped by DPOs (Disabled Persons' Organizations).

    • In Bantul Regency, vulnerable groups were found who could not exercise their right to vote at the TPS due to mobility barriers.

    • A number of TPS were not disability-friendly because the location was tiered or had stairs that made it difficult for wheelchair users.

    • The tactile voting aids for visually impaired persons were not available for all ballot papers, so the Polling Station Working Committee (KPPS) only provided 2 out of the 4 ballot papers that needed to be voted on to the visually impaired, namely the Presidential-Vice Presidential ballot and the Regional Representatives Council (DPD) ballot.

    • There were persons with mental disabilities who came to the TPS since the morning, but until the end of the election did not vote and were told to go home.

  • There have been efforts made by the Indonesian Government to ensure the rights of persons with disabilities in the political field, both to ensure the accessibility of persons with disabilities and the socialization of accessible elections to the disabled community. What became controversial during the 2019 Election was that the General Elections Commission (KPU) recorded persons with mental/psychosocial disabilities and stated that this disability group had the right to vote. Socialization was also encouraged by disabled persons' organizations, such as PPUA, to push the Government/KPU/KPUD to provide accessible facilities, such as braille or sign language interpreters.

  • In its implementation, not all regions or disabled communities received their political rights or election-related socialization. In Jakarta, Yogyakarta, and Riau, for example, accessible election training and socialization were carried out, but not all types of disabilities were involved.

  • Some current obstacles in the Election for persons with disabilities are related to:

    • Campaign/educational materials that are not socialized in detail and thoroughly to persons with disabilities, so many persons with disabilities still do not understand the materials and how to use their right to vote in the election.

    • Minimal information and knowledge about political and public life that is accessible to various types of disabilities, thereby hindering their participation.

    • Low involvement of persons with disabilities in politics or the public sphere, including women with disabilities. This is more related to the need for significant resources, and in some cases, there is still reluctance from the public to elect persons with disabilities because of their disability.

The Committee recommends that the State Party:

  • Implement specific measures to ensure the equality and participation of underrepresented groups of persons with disabilities, including deaf persons, persons with intellectual disabilities, persons with psychosocial disabilities, deaf-blind persons, and women with disabilities;

  • Ensure that polling stations, electoral and voting procedures, facilities, and online or printed electoral materials are accessible to all persons with disabilities;

  • Develop information and training for election officials to ensure an appropriate response to the access needs of persons with disabilities.
